Yes, War Does Make Us Poor

Congressman Conyers and Grayson are on to a good idea by floating H.R. 5353. The "War is Making You Poor Act" seeks curb the out of control costs that the Defense Department burdens the American people with every year. While keeping our country safe is a top priority, the fact is we spend more on our military than the next top fifty countries combined.

H.R. 5353 is pretty cut and dry:

It seems that Rep. John Conyers (D-MI) would agree, perpetual war is making you poor.

To begin rectifying the situation, he's joined with Congressman Alan Grayson (D-FL) in co-sponsoring the "War is Making You Poor Act," which would limit defense spending to $548.9 billion: the exact figure alloted in the fiscal year 2011 budget.

Oh and there's this that might help sweeten the pot:

The act also seeks to utilize an additional $159.3 billion set aside for "discretionary" operations abroad to relieve the full federal income tax burden on every American's first $35,000 earned per year, or up to $70,000 per year for married couples.

While this is great news, it is only a start. Simply halving that massive budget would go a long way in solving many of our top domestic priorities, such as education, health care and job development to name a few (this pie chart helps put things into perspective). Unfortunately though, the defense industry is well staffed with many lobbyists that ensure that anything less than a large yearly increase for their weapons contracts would be akin to hating America and letting the terrorists win. If Conyers and Grayson could pass this Act, it would be a big step in the right direction, even if it only caps the spending where it is now.

Rep. Conyers Does What Sen. Leahy Was Too Afraid Of

This past week a group of Vermont citizens found out that their senior senator had failed them in seeking out justice and accountability for the crimes committed by the Bush Administration. Not only did Leahy not demand those accused to be tried in court, he couldn't muster the courage to call for a phony "Truth Commission" that would air out all the dirty laundry of the past eight years. Thankfully though we have a fighter in House that is willing to go above and beyond Vermont's weak-kneed senator.

On Thursday, House Judiciary Committee Chairman John Conyers quietly released the final draft of an extensive report he first unveiled in January documenting the Bush administration’s “unreviewable war powers” and the possible crimes committed in implementing those policies.

In order to determine whether Bush officials broke laws, Conyers has recommended that Attorney General Eric Holder appoint a special prosecutor to launch a criminal inquiry to investigate, among other things, whether “enhanced interrogation techniques” used against alleged terrorist detainees violated international and federal laws against torture.

“The Attorney General should appoint a Special Counsel to determine whether there were criminal violations committed pursuant to Bush Administration policies that were undertaken under unreviewable war powers, including enhanced interrogation, extraordinary rendition, and warrantless domestic surveillance,” Conyers’s report says. “In this regard, the report firmly rejects the notion that we should move on from these matters.” An earlier draft of the report contained a similar recommendation, but the final version includes additional evidence that has surfaced since January to support Conyers's reasoning s for a special prosecutor. The updated version “highlights significant source materials and Judiciary Committee accomplishments, and accounts for the final days of the Bush Administration.”
Now the ball is in Attorney General Holder's court. Far from the Bush sycophant that former A.G. Mukasey was, Holder has a much higher regard for the rule of law. Of course he still actually has to go through with appointing a prosecutor, so he has to prove he's worthy in the eyes of the law. Hopefully Obama and his top man at the Justice Department will have the agency live up to its' name for the first time in over eight year.

Conyers' Proposed Prez Powers Commission Doesn't Go Far Enough

Not only is John Conyers busy protesting Sanjay Gupta, he is looking ahead to starting a commission to investigate what the hell went on in the last eight years. There is plenty we already know, but didn't go on the record because we had a combination of a timid Democratic Congress and a Republican one that didn't care. The question is though, is it enough?

In one of the first acts of the 111th Congress, House Judiciary Committee Chairman John Conyers proposed legislation to create a blue-ribbon panel of outside experts to probe the “broad range” of policies pursued by the Bush administration “under claims of unreviewable war powers,” including torture of detainees and warrantless wiretaps.

Conyers’s proposal for a National Commission on Presidential War Powers and Civil Liberties also signals that Congress will devote significant time this year to investigating the Bush administration’s most controversial actions with an eye to rolling back its expansion of executive power.

Many civil liberties and human rights groups feared that the Democratic-controlled Congress and Barack Obama’s administration would duck any sustained inquiry into wrongdoing by George W. Bush and his subordinates, to avoid angering Republicans.

While Conyers’s plan falls short of the criminal probe that civil rights groups have sought, neither would it prevent a criminal investigation by Obama’s Justice Department if the new administration moves in that direction, said two aides on Obama’s transition team who spoke on condition of anonymity.
I'm glad that Obama's people are still thinking about the possibility of criminal investigations. Conyers however, isn't willing to go the distance that is necessary. Bush, Cheney and the rest of the cabal deserve to be put in front of the full force of the law. We aren't looking for slaps on the wrist or a sternly worded letter. This isn't about revenge, it is simply so that we as a nation of laws (not men) follow those laws. Conyers should not be afraid of that and neither should the rest of Congress.

Conyers Goes After Obama For Thinking Of Gupta For Surgeon General

While Barack Obama has done many things right since being elected President, one of the odder items has been floating the name of Sanjay Gupta for Surgeon General. Sure, people know him from CNN and he is a brain surgeon, but is that really enough to be Surgeon General. Plenty of people think not, including Paul Krugman. Krugman cites his rash behavior with Michael Moore and oh-so-closeness with Big Pharma, both good reasons. Yet his complaints do not even come close to having the pull of someone like John Conyers.

I join in opposition with respected Noble Peace Prize award wining economist Paul Krugman, who has very serious concerns with having Dr. Gupta be the nation's Surgeon General. [...]

Also, there are highly experienced medical professionals who question whether Dr. Gupta has the necessary experience or even the medical background to be in charge of some 6,000 physicians or more who work in the United States Public Health Service. Gerard M. Farrel, Executive Director of the Commissioned Officers Association, stated in the January 7, 2008 Washington Post that Dr. Gupta will certainly face a "credibility gap" because he never served in the National Health Service Corp, and furthermore, does not have the "experience or qualifications to be the leader of the nation's public health service." Clearly, it is not in the best interests of the nation to have someone like this who lacks the requisite experience needed to oversee the federal agency that provides crucial health care assistance to some of the poorest and most underserved communities in America.
Gupta may be media savvy and as pointed out on The Daily Show last night, perhaps a little too much so. Humor aside, this is a serious position that must be filled and Gupta really doesn't have the experience necessary. He should stick to CNN and all sorts of pithy commentary (he can even keep defending Big Pharma) and leave the administrative work to those that know what they're doing. Perhaps Obama should talk to former Surgeon General Richard Carmona when going back to the drawing board on this one.

House Cmte Votes For Rove To Be In Contempt, Now What?

First of all I'd like to congratulate the House Judiciary Committee on showing the tiniest hint of a spine by holding Karl Rove in contempt of Congress. He feels that since he worked for George Bush, that magically puts him above the law. Well the framers of our country and our Constitution felt differently, and so should all of us. So procedurally speaking, Chairman Conyers did his job by moving this along to the full House.

The House Judiciary Committee's 20-14 vote along party lines escalated the dispute between the Bush administration and the Democratic-controlled Congress over lawmakers' demand for testimony by presidential aides.

President George W. Bush has invoked executive privilege to bar his aides from testifying under oath in Congress about the firing of nine U.S. attorneys. The president also barred Rove's testimony on the prosecution of former Alabama Governor Don Siegelman.

The panel has asked a federal judge to order Bush's chief of staff, Joshua Bolten to turn over documents about the firings and to direct former White House counsel Harriet Miers to testify about the dismissals.


So now that John Conyers had his committee vote for contempt, it is up to the full Congress to vote on it. Say they hold him in contempt in a week or two from now. When Rove sticks his middle finger at that, will Congress go all the way and put him in jail? More than a hundred-thousand have already signed the pledge (including myself) for them to do so. This is really simple, Karl Rove broke the law for political reasons, going as far as having a governor put in jail for purely vindicative reasons. Now that we found out what he was up to, it is time to have justice give him the swift kick in the ass that he justly deserves. Any other conclusion is completely unacceptable.

Apparently The Constitution Does Not Apply To Mr. Rove

It isn't breaking news that Karl Rove or anyone in or out of the Bush White House has any regard for our nation's highest governing document. What's the Constitution anyways when you have a lust for all encompassing power and a need to be above the law? Well Karl Rove does not have to come out and say that he or his friend the President want dictatorial powers in order to ignore the Congress, they just do it. And now they mock it.

House Judiciary Committee Chairman John Conyers, Jr. (D-MI) issued a subpoena Thursday to former White House Deputy Chief of Staff Karl Rove for testimony about politicization of the Department of Justice (DOJ), including the case of former Alabama Governor Don Siegelman, who was jailed for bribery in what was widely seen as a political prosecution.

In response, Rove's attorney Robert Luskin questioned why the subpoena was necessary and mocked Conyers in a letter copied to RAW STORY.

"I do not misunderstand either the Committee's procedures or the scope of its interest in Mr. Rove; nor, in light of your reported remarks about the need for 'someone' to 'kick his ass,' am I the least bit confused about the Committee's motives and intentions," Luskin wrote. "I confess, however, that I do not understand why the Committee is threating a subpoena to Mr. Rove for information related to the alleged 'politicization of the Department of Justice,' when, as the Committee is surely aware, Mr. Rove has already received a subpoena for the same subject matter from the Senate Judiciary Committee."


How sad that the media then buys that this is strictly a partisan story. If the politicization of the Department of Justice is alleged, why can't Karl Rove voluntarily come to Congress to discuss that, under oath? Whats the harm if there has been no foul? The problem is, as we already know, there have been multiple fouls and Rove does not want to be held accountable for his criminal behavior. He hasn't shown up for his first subpoena from the Senate, the Department of Justice will not fulfill its duty to compel him to testify and the loser here is all of us and the health of our democracy.

All I have to say is that our next President, in addition to the hope and change he brings, better make sure that all those guilty of high crimes and misdemeanors be brought forward to face justice and not be allowed to get away with the raping of our Republic.

Constitutional Showdown: Bush Vs democracy

Although the amount of time it took was surprising, the Bush Administration's lackey Michael Mukasey (a.k.a. United States Attorney General) handed back an all too expected response to Congress that he will not fulfill his duty to prosecute Miers and Bolten. When it comes down to it, Bushies will protect Bushies over the Constitution any day of the week. So what is Congress going to do about it?

WASHINGTON — Attorney General Michael Mukasey refused Friday to refer the House's contempt citations against two of President Bush's top aides to a federal grand jury. Mukasey said White House Chief of Staff Josh Bolten and former presidential counsel Harriet Miers committed no crime.

As promised, House Speaker Nancy Pelosi announced that she has given the Judiciary Committee authority to file a lawsuit against Bolten and Miers in federal court.

"The House shall do so promptly," she said in a statement.

Mukasey said Bolten and Miers were right in ignoring subpoenas to provide Congress with White House documents or testify about the firings of federal prosecutors.


First off, Mukasey doesn't know shit other than subverting the rule of law. For him to decide what is right or wrong is ridiculous. If your goal is to thrash our system of government and install an autocratic dictator, then maybe you are on the right track. Its just, well, the American people might have something to say about that.

So anyway, this civil lawsuit will go to a judge sooner or later. Mukasey will argue that Miers and Bolten could not testify because the President said so. He obviously believes Bush has more power than the Congress, despite the fact that the United States was set up with three co-equal branches of government. This isn't a case that is hard to determine, it is a slam freakin dunk for Congress. All this does is delay the American people from hearing the truth about what Miers and Bolten did on behalf of the White House.

Oh and just in case you forgot what this whole brouhaha is about.....Bush and his cohorts had United States Attorneys fired for not prosecuting people based on the political beliefs of the Bush Administration. When several of the dismissed Attorneys came forward with what happened, Congress started asking questions and no one that is involved with doing the firing is answering. Finding out those answers could implicate Bush Administration officials in a crime. The American people deserve the answer, and those that violated any laws of our land must be held accountable. It is that simple.

Wow, Pelosi Actually Wrote The Letter

Congratulations Madam Speaker:

Washington, D.C. – Today, Speaker Nancy Pelosi sent the following letter to U.S. Attorney General Michael Mukasey, informing him of the referral letter sent to U.S. Attorney of the District of Columbia Jeffrey Taylor on contempt citations of former White House Counsel Harriet Miers and White House Chief of Staff Joshua Bolten. Taylor is required by law to bring the matter before a grand jury. However, Mukasey has indicated that the Justice Department intends to prevent Taylor from complying with the law.

“There is no authority by which persons may wholly ignore a subpoena and fail to appear as directed because a President unilaterally instructs them to do so. Even if a subpoenaed witness intends to assert a privilege in response to questions, the witness is not at liberty to disregard the subpoena and fail to appear at the required time and place. Surely, your Department would not tolerate that type of action if the witness were subpoenaed to a federal grand jury,” she wrote.

“I strongly urge you to reconsider your position and to ensure that our nation is operating under the rule of law and not at presidential whim,” she added.

Two weeks ago, the House passed H.R. 979, which holds Miers and Bolten in contempt of their subpoenas.


You can read the letter via the link if you so choose, but this excerpt sums it up. Now the ball is in Mukasey's court. Will he comply with the Constitution, or continue being Bush's lackey? I'm going to go with the latter, you know, based on the last seven-plus years of this pathetic excuse of a Presidential Administration.

So once he ignores the letter, Pelosi will have the Judiciary Cmte (see Congressman Conyers) file a civil suit. This is the agreed upon action and it isn't even an idea hatched by Democrats. No, this one was concocted by no less than James Sensenbrenner, the Judiciary Cmte Chairman back when the GOP held the house.

Gee, look at that, Republicans actually do have some relevant ideas!

Republicans Literally Walkout From Accountability!

In an un-Democratic Party way, the leadership in the House of Representatives stood up and demanded accountability from White House personnel that disregarded Congressional subpoenas. After several long months of House Democrats hemming and hawing, they finally brought the resolution to the floor that held Harriet Miers and Josh Bolten in contempt of Congress. Well one bold act deserves another, and Republicans did just that.

On a vote of 223-to-32 House Democrats succeeded in passing the contempt charges against White House Chief of Staff Josh Bolten and former counsel Harriet Miers, after Republicans walked out in protest.

House Republicans staged a walk-out Thursday afternoon to protest the contempt vote and the failure by the chamber's majority members to bow to President Bush's demands on a controversial spying law.

"We will not stand here and watch this floor be abused for pure political grandstanding at the expense of our national security. ... Let's just get up and leave," Republican Leader John Boehner advised his colleagues as they dramatically left the floor Thursday afternoon.


When faced with the dilemma of participating in holding members their own party accountable, they act like five year olds and walkout. Truly pathetic!

Forget about Boehner and company though, the true test is to see whether the Attorney General will actually follow the rules set forth in the Constitution and have this matter adjudicated. So far I have little hope in Mukasey, but time will tell I guess.

Karl Rove Et. Al. Served Subpoenas

It is about time someone makes Bush's Brain talk under oath. He may give a lot of poisonous speeches to his blind and dimwitted followers but he is no match for John Conyers and Company. There are so many things to investigate Karl Rove over but Conyers picked just one. Rove has been fingered as a major facilitator in the firing of eight U.S. Attorneys for political purposes. So far Alberto Gonzales has lied under oath, I wonder if Karl Rove will as well.

According to a release, "The Subcommittee on Commercial and Administrative Law (CAL) will meet TOMORROW, March 21st at 10:15 am in 2141 Rayburn House Office Building to consider subpoenas for Kyle Sampson, Karl Rove, Harriet Miers, William Kelley, and Scott Jennings, as well as White House and Justice Department documents, which have not been provided to date."
