Nadler Calls For Bybee Impeachment

Manhattan Congressman Jerry Nadler spoke out yesterday for the impeachment of Judge Jay Bybee. Bybee has become infamous for having written out the "legal" doctrine that authorized hundreds of acts of torture by agents of the United States government, sanctioned by the Bush Administration. This is one man that should definitely not be adjudicating from the bench of any court, even one's with kangaroos.

"He ought to be impeached," Nadler said in an interview with the Huffington Post. "It was not an honest legal memo. It was an instruction manual on how to break the law."[...]

"Any special prosecutor on torture would have to look at the authors of those torture memos," said Nadler. "And certainly you have real grounds to impeach him once the special prosecutor took a good look at that. I think there ought to be an impeachment inquiry looked at in any event. Which should happen first, I'm not sure."[...]

"He should be a target. Yoo should be a target. There are a number of targets," said Nadler, referring to for Bush administration counsel John Yoo, who also authorized torture and is now a professor at the University of California, Berkeley. Bybee, noted Nadler, "is the only one who's a federal court judge now."

Nadler dismissed Obama's call to look forward rather than backward, arguing that the United States is obligated to investigate whether crimes were committed. "This whole call of looking forward rather than backwards -- you can't say that. The fact is, if crimes were committed, we are duty-bound under our law, we must -- the United States must investigate torture if it happened in America. That's the law. And the fact is, the law specifically says that instructions from higher officials is not an excuse. And we are obligated to investigate and, if indicated, to prosecute. The failure to at least investigate would be a violation of law," he said.

I couldn't agree more. We need to prosecute Bybee, Yoo and every last one of them that was inside the Bush White House and approved these unholy, unethical and illegal acts. If we have to start with Bybee and work our way up, so be it. The important thing is that we do it, and quickly, so that Bush (and maybe even Cheney) is still alive when he goes to jail for his war crimes.

Rep. Conyers Does What Sen. Leahy Was Too Afraid Of

This past week a group of Vermont citizens found out that their senior senator had failed them in seeking out justice and accountability for the crimes committed by the Bush Administration. Not only did Leahy not demand those accused to be tried in court, he couldn't muster the courage to call for a phony "Truth Commission" that would air out all the dirty laundry of the past eight years. Thankfully though we have a fighter in House that is willing to go above and beyond Vermont's weak-kneed senator.

On Thursday, House Judiciary Committee Chairman John Conyers quietly released the final draft of an extensive report he first unveiled in January documenting the Bush administration’s “unreviewable war powers” and the possible crimes committed in implementing those policies.

In order to determine whether Bush officials broke laws, Conyers has recommended that Attorney General Eric Holder appoint a special prosecutor to launch a criminal inquiry to investigate, among other things, whether “enhanced interrogation techniques” used against alleged terrorist detainees violated international and federal laws against torture.

“The Attorney General should appoint a Special Counsel to determine whether there were criminal violations committed pursuant to Bush Administration policies that were undertaken under unreviewable war powers, including enhanced interrogation, extraordinary rendition, and warrantless domestic surveillance,” Conyers’s report says. “In this regard, the report firmly rejects the notion that we should move on from these matters.” An earlier draft of the report contained a similar recommendation, but the final version includes additional evidence that has surfaced since January to support Conyers's reasoning s for a special prosecutor. The updated version “highlights significant source materials and Judiciary Committee accomplishments, and accounts for the final days of the Bush Administration.”

Now the ball is in Attorney General Holder's court. Far from the Bush sycophant that former A.G. Mukasey was, Holder has a much higher regard for the rule of law. Of course he still actually has to go through with appointing a prosecutor, so he has to prove he's worthy in the eyes of the law. Hopefully Obama and his top man at the Justice Department will have the agency live up to its' name for the first time in over eight year.

Eric Holder As Our Next Attorney General?

A far cry from Alberto Gonzales, Eric Holder would be the nation's first African American AG and one that actually respects the rule of law. One thing you could count on with Bush, following the Constitution was never a priority. Starting January 20th, it'll be at the top of the list.
